AGREEMENT TO OUR LEGAL TERMS

We are Anthony William Phippen, doing business as Weekly (“Company,” “we,” “us,” or “our”), a sole trader registered in England and Wales at 124 Granville Avenue, Feltham, London, TW13 4JN.

We operate the website https://goweekly.app (the “Site”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

Weekly is an AI-powered meal planning service that generates personalised weekly meal plans based on your dietary preferences, calorie and macro targets, and budget. Plans include shopping lists, cooking instructions, and optional tweaks — all powered by artificial intelligence.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Anthony William Phippen trading as Weekly, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the “Last updated” date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.

The Services are intended for users who are at least 13 years old. Persons under the age of 13 are not permitted to use or register for the Services.

1. OUR SERVICES

Weekly provides AI-generated meal plans tailored to your personal dietary goals, preferences, and budget. Meal plans are generated using artificial intelligence and are intended as a general guide only. They do not constitute medical, nutritional, or dietary advice. You should consult a qualified healthcare professional before making significant changes to your diet, particularly if you have any medical conditions, allergies, or specific nutritional requirements.

The Services are hosted in the United States via Vercel. By using the Services, users outside the United States consent to their data being transferred to and processed in the United States, in accordance with our Privacy Policy.

2. INTELLECTUAL PROPERTY RIGHTS

Our intellectual property

We are the owner or licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, text, and graphics (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”).

Our Content and Marks are protected by copyright and applicable intellectual property laws in the United Kingdom and internationally.

Your use of our Services

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services solely for your personal, non-commercial use.

No part of the Services and no Content or Marks may be copied, reproduced, republished, uploaded, posted, publicly displayed, translated, transmitted, distributed, sold, or otherwise exploited for any purpose without our express prior written permission. Requests can be directed to hello@goweekly.app.

Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.

Your submissions

By sending us any question, comment, suggestion, idea, or feedback about the Services (“Submissions”), you agree that we may use such Submissions for any lawful purpose without obligation, compensation, or acknowledgment to you.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity to agree to these Legal Terms; (4) you are not under the age of 13; (5) you will not access the Services through automated or non-human means; (6) you will not use the Services for any illegal or unauthorised purpose; and (7) your use of the Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, or incomplete, we have the right to suspend or terminate your account and refuse any current or future use of the Services.

4. USER REGISTRATION

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

5. PURCHASES AND PAYMENT

We accept payment via credit and debit card through our payment processor, Stripe. You agree to provide current, complete, and accurate payment information for all purchases made via the Services. All payments are in pounds sterling (GBP). We may change prices at any time and will communicate any changes in accordance with applicable law.

We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

6. SUBSCRIPTIONS

Billing and Renewal

Your subscription will continue and automatically renew each month unless cancelled. You consent to your payment method being charged on a recurring monthly basis without requiring prior approval for each charge, until you cancel.

Free Trials

We do not offer a standard free trial. However, we may at our sole discretion offer promotional trial access to selected individuals for feedback or marketing purposes. Any such trial will be communicated directly and is non-transferable.

Cancellation

You can cancel your subscription at any time by logging into your account and managing your subscription settings. Your cancellation will take effect at the end of the current paid billing period. If you have any questions or are unsatisfied with our Services, please contact us at hello@goweekly.app.

Fee Changes

We may, from time to time, make changes to the subscription fee and will communicate any price changes to you in accordance with applicable law, including the UK Consumer Rights Act 2015 where relevant.

7. RETURN/REFUNDS POLICY

As a general rule, all subscription payments are final and non-refundable once the billing period has commenced and Pro features have been accessed. However, if you contact us at hello@goweekly.app within 7 days of your first payment and have not used any Pro features, we will consider a refund at our discretion. We handle all refund requests on a case-by-case basis and reserve the right to decline requests that do not meet this criteria.

Nothing in this policy affects your statutory rights under UK consumer law.

8. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

  • Systematically retrieve data or other content from the Services to create or compile a collection, database, or directory without written permission from us.
  • Make any unauthorised use of the Services, including collecting email addresses of users by electronic or other means for the purpose of sending unsolicited email.
  • Circumvent, disable, or otherwise interfere with security-related features of the Services.
  • Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
  • Engage in any automated use of the system, such as using scripts, data mining tools, robots, or similar data gathering tools.
  • Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
  • Attempt to impersonate another user or person.
  • Use the Services as part of any effort to compete with us or for any revenue-generating endeavour without our express permission.
  • Decipher, decompile, disassemble, or reverse engineer any of the software comprising or making up part of the Services.
  • Upload or transmit viruses, Trojan horses, or other harmful material that interferes with any party's use and enjoyment of the Services.
  • Use the Services in a manner inconsistent with any applicable laws or regulations.

9. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who violates the law or these Legal Terms; (3) refuse, restrict access to, or disable any portion of the Services at our discretion; and (4) otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

10. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy at https://goweekly.app/privacy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. The Services are hosted in the United States. If you access the Services from the United Kingdom or European Economic Area, your data will be transferred to and processed in the United States. We take appropriate safeguards to ensure your data is handled in accordance with UK GDPR.

11. TERM AND TERMINATION

These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to deny access to the Services to any person for any reason, including for breach of these Legal Terms. We may terminate your account at any time without warning at our sole discretion.

If we terminate or suspend your account for any reason, you are prohibited from registering a new account under your name or any other name without our express permission.

12. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time at our sole discretion without notice. We cannot guarantee the Services will be available at all times. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.

13. GOVERNING LAW

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. DISPUTE RESOLUTION

We encourage you to contact us first at hello@goweekly.app if you have any concerns, and we will make every reasonable effort to resolve any issue informally. If a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the courts of England and Wales as set out above.

15. CORRECTIONS

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information on the Services at any time without prior notice.

16. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. MEAL PLANS GENERATED BY WEEKLY ARE PRODUCED BY ARTIFICIAL INTELLIGENCE AND ARE INTENDED AS A GENERAL GUIDE ONLY. THEY DO NOT CONSTITUTE MEDICAL OR NUTRITIONAL ADVICE. YOU USE THE SERVICES AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE CONTENT GENERATED BY THE SERVICES.

17. LIMITATIONS OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 3 MONTHS PRIOR TO THE CAUSE OF ACTION ARISING. NOTHING IN THESE LEGAL TERMS SHALL LIMIT OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED BY ENGLISH LAW.

18. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable legal fees, arising out of: (1) your use of the Services; (2) breach of these Legal Terms; (3) any breach of your representations and warranties set out in these Legal Terms; or (4) your violation of the rights of any third party.

19. USER DATA

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services. Although we perform regular backups, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. We shall have no liability to you for any loss or corruption of any such data.

20. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By using the Services, sending us emails, and completing online forms, you consent to receive electronic communications. You agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

21. MISCELLANEOUS

These Legal Terms and any policies posted by us on the Services constitute the entire agreement between you and us. If any provision of these Legal Terms is found to be unlawful or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision. We may assign our rights and obligations to others at any time.
